3. Estimates and Contracts
All estimates provided are based on the information available at the time of inspection. Final pricing may vary if unforeseen conditions are discovered during the work. Any changes to scope or pricing will be communicated and approved in writing before proceeding. Written contracts will specify project scope, materials, timeline, payment terms, and warranty information. Both parties must sign the contract before work begins.
4. Payment Terms
Payment terms will be specified in your written contract. Typically, we require a deposit before starting work and final payment upon completion. We accept various payment methods as specified in your contract. Late payments may be subject to additional fees. If payment is not received according to the agreed terms, we reserve the right to suspend work until payment is made.
5. Project Timeline
We will provide estimated project timelines in your written contract. While we strive to complete all work within the specified timeframe, certain factors beyond our control may cause delays, including weather conditions, material availability, unforeseen site conditions, or changes to project scope. We will communicate any expected delays as soon as possible and work to minimize impacts to your schedule.
6. Warranties
We stand behind our work with warranties that cover workmanship and installation as specified in your contract. Warranty terms vary by project type and will be detailed in writing. Our warranties do not cover damage from accidents, misuse, normal wear and tear, natural settling, or failure to follow maintenance recommendations. To maintain warranty coverage, you must follow all care and maintenance instructions provided.
7. Property Access and Preparation
You agree to provide clear access to the work area and ensure any necessary permits are obtained before work begins. You are responsible for marking or protecting any underground utilities, sprinkler systems, or other buried infrastructure. We will take reasonable care to protect your property, but are not responsible for damage to unmarked utilities or obstacles not disclosed during the initial consultation.
8. Cancellation and Changes
If you need to cancel or reschedule your project, please notify us as soon as possible. Cancellation fees may apply depending on when notice is provided and how much work has already been completed or materials ordered. Changes to project scope must be approved in writing and may affect pricing and timeline. We reserve the right to charge for additional work or materials not included in the original contract.
9. Limitation of Liability
Our liability is limited to the amount you paid for the services provided. We are not liable for indirect, incidental, or consequential damages arising from our services. We carry appropriate insurance coverage as required by law. Any claims must be made in writing within 30 days of project completion or discovery of the issue.
10. Dispute Resolution
If a dispute arises, we encourage direct communication to resolve the matter. If we cannot reach a resolution, both parties agree to attempt mediation before pursuing legal action. Any legal proceedings will be conducted in the appropriate courts of Ohio. The prevailing party in any dispute may be entitled to recover reasonable attorney fees and costs.
11. Safety and Compliance
We follow all applicable safety regulations and building codes in our work. During the project, please keep children and pets away from the work area for their safety. We reserve the right to stop work if unsafe conditions are present. You agree to allow our crew reasonable time and space to complete the work safely and properly.
12. Intellectual Property
Any designs, plans, or creative work we provide remain our intellectual property unless otherwise agreed in writing. You may not reproduce, distribute, or use our materials for other projects without permission. We reserve the right to photograph completed projects for marketing purposes unless you specifically request otherwise in writing.
13. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective when posted on our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms. We encourage you to review these terms periodically.
